Terms of Service

• "Product" means any server plugin for Ark Survival Ascended, Discord bot, or other digital good offered through the Service, including updates we choose to release.
• "License" means the limited right to use a paid Product granted under Section 4, evidenced by a license key issued to your account.
• "Lifetime License" means a License purchased with a single one time payment, as defined and limited in Section 5.
• "Product Support Lifetime" means the period during which we, at our sole discretion, continue to offer, maintain, or operate a given Product, including its license validation service.
• "Subscription" means a recurring weekly, monthly, or yearly purchase that renews automatically until cancelled.

• You must be at least 18 years old, or the age of majority where you live, to make a purchase. If you are younger, you may use the Service only with the involvement and consent of a parent or legal guardian who accepts these Terms on your behalf.
• Sign in is provided exclusively through Discord. You are responsible for the security of your Discord account; everything done through it on the Service is attributed to you.
• You agree to provide accurate information and not to create accounts to evade a ban, circumvent activation limits, or abuse promotional terms. We may refuse, suspend, or close any account as described in Section 11.

• Payments are processed by Stripe, Inc. ("Stripe"). We never receive or store your full card details. Your use of the Stripe checkout is also subject to the terms and privacy policy published by Stripe.
• All prices are stated in US dollars and, unless expressly stated otherwise, exclude any applicable sales tax, VAT, or similar charges, which are your responsibility where they apply.
• We may change prices at any time. Price changes apply prospectively: they never change what you already paid, and for Subscriptions they take effect no earlier than your next renewal.
• Obvious pricing errors do not bind us. If a Product is listed at a manifestly wrong price, we may cancel the purchase and refund the amount paid in full.

Subject to these Terms and to payment in full, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable License to install and run the purchased Product on game servers or Discord servers that you operate, up to the activation limit shown for the Product. All rights not expressly granted are reserved. A purchase is a license, not a sale of the software.

• License enforcement is technical as well as contractual. Paid Products periodically validate your license key against our servers and bind activations to a hardware or server identifier. You consent to this validation as a condition of use.
• You may not sell, rent, lease, share, publish, or otherwise transfer a license key or a paid Product to any third party, including inside hosting marketplaces or reseller bundles, without our prior written consent.
• You may not reverse engineer, decompile, modify, or create derivative works of a paid Product, and you may not remove, disable, or circumvent license validation or any other protection measure, except to the narrow extent a mandatory law expressly permits an act despite this prohibition.
• You may not use any Product to violate law, the rules of Discord or of the game whose servers you operate, or the rights of any third party.

A Lifetime License is a single payment for a License that lasts for the Product Support Lifetime of the specific Product purchased. "Lifetime" refers to the life of the Product, not to your lifetime and not to a promise that the Product, the game it targets, or the Service will exist forever. You acknowledge and agree that:

• We decide, at our sole discretion, whether and how long to maintain, update, support, or operate any Product. We may reduce, pause, or permanently end development, support, or the license validation service for any Product at any time.
• When a Product reaches the end of its Product Support Lifetime, the associated Licenses, including Lifetime Licenses, lapse. Because paid Products validate against our servers, a Product may stop functioning after validation ends. No refund, credit, or replacement is owed for a Product that reaches end of life, except where mandatory law provides otherwise.
• A Lifetime License remains subject to revocation for cause under Section 11 at any time, exactly like any other License.
• Game publishers change their games. An update to Ark Survival Ascended, to Discord, or to any other platform may break a Product at any time, and compatibility work after such changes is at our discretion.

• Subscriptions renew automatically at the interval you selected until you cancel. Cancelling stops the next renewal; your License stays valid until the end of the period you already paid for, and no partial period is refunded.
• You can cancel, change your plan, and update your payment method at any time in the Stripe billing portal, reached from your billing dashboard.
• If a renewal payment fails, we may keep your License active for a short grace period while the charge is retried. If payment is not completed, the License expires and access ends.

All sales are final. Because Products are digital goods delivered immediately, we do not offer refunds, returns, or exchanges, and dissatisfaction, change of mind, unused time, server closure, a game update breaking a Product, or the end of a Product Support Lifetime are not grounds for a refund. A refund is provided only in the following explicitly stated situations:

• You were charged twice for the same purchase. The duplicate charge is refunded.
• You paid but the Product was never delivered to your account, you reported it to [email protected] within 14 days of the charge, and we could not deliver it within a reasonable time after your report.
• We cancel a purchase ourselves under Section 3 (pricing error) or withdraw a Product before delivering it to you.
• A refund is required by mandatory law that applies to your purchase.

Where you have a statutory withdrawal or cooling off right for digital content, you expressly request immediate delivery at checkout and acknowledge that the right is lost once delivery begins, to the extent the applicable law allows that waiver.

Initiating a payment dispute or chargeback instead of contacting us is a material breach of these Terms. On receipt of a chargeback we may immediately revoke every License and entitlement on your account, freeze the account pending resolution, and permanently refuse future service. We reserve the right to contest disputes with our delivery and activation records.

• Support is provided at our discretion, primarily through our Discord server and [email protected]. We do not promise response times, outcomes, uptime, or any service level, and support is offered only during the Product Support Lifetime of the relevant Product.
• Updates, fixes, and new features are released if and when we choose. Purchasing a Product is payment for the Product as it exists at purchase, not for future development.
• We may condition support on reasonable conduct. Abusive, threatening, or persistently disruptive behavior toward us or our community ends your access to support and may lead to termination under Section 11.

You agree not to:

• probe, overload, or disrupt the Service, circumvent rate limits, or access any part of it through automated means except public pages and documented APIs;
• attempt to access accounts, licenses, files, or data that do not belong to you, or share download links, tokens, or gated artifacts with third parties;
• misrepresent your identity, impersonate us, or claim an affiliation with NordBots that does not exist;
• use the Service or any Product for unlawful, fraudulent, or malicious activity of any kind.

The Products, the Service, and all associated code, branding, and content are owned by Lucas Fredriksson and protected by copyright and other laws. If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty free right to use them without obligation to you. To report content you believe infringes your rights, contact [email protected] with enough detail for us to assess the claim.

To the maximum extent permitted by applicable law, we may refuse service to anyone. We may suspend or terminate your account, revoke any or all of your Licenses, including Lifetime Licenses, ban you from our Discord server, and block future purchases, immediately and without prior notice, if:

• you materially breach these Terms, including the license restrictions in Section 4;
• you initiate a chargeback or your payment is reversed, reversed in part, or found fraudulent;
• you share, resell, leak, or attempt to crack license keys or gated files, or interfere with license validation for any user;
• you abuse, defraud, threaten, or harass us, our community, or other customers; or
• we are required to do so by law or by a platform we depend on.

We may also terminate for convenience with reasonable notice, in which case Section 5 governs Products at end of life. On any termination for cause, amounts paid are not refunded except where mandatory law requires. Sections 4, 5, 7, and 10 through 16 survive termination.

The Service depends on third parties we do not control, including Stripe for payments, Discord for sign in and community features, and Cloudflare for content delivery and storage. Their availability, terms, and changes are outside our responsibility, and an outage or policy change of a third party is not a breach of these Terms by us.

THE SERVICE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED OPERATION, OR COMPATIBILITY WITH ANY GAME OR PLATFORM VERSION. YOU USE SERVER PLUGINS AT YOUR OWN RISK, INCLUDING THE RISK OF DATA LOSS ON SERVERS YOU OPERATE; MAINTAIN YOUR OWN BACKUPS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NORDBOTS AND LUCAS FREDRIKSSON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATING TO THE SERVICE OR ANY PRODUCT. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR WILLFUL MISCONDUCT OR GROSS NEGLIGENCE WHERE SUCH A LIMIT IS PROHIBITED.

You will defend, indemnify, and hold harmless Lucas Fredriksson and NordBots from claims, damages, and reasonable costs, including attorney fees, arising from your breach of these Terms, your use of the Products on servers you operate, or your violation of law or third party rights, except to the extent caused by our own breach of these Terms.

These Terms are governed by the laws of the United States and of the state in which the operator resides, without regard to conflict of law rules, except where the mandatory consumer protection law of your country of residence applies and cannot be derogated from by agreement. Before filing any claim, you agree to contact [email protected] and give us 30 days to resolve the dispute informally. Any claim must be brought within one year of the events giving rise to it, where the law allows that limit. Each party waives any right to participate in a class action against the other, to the extent that waiver is enforceable where you live.

We may update these Terms from time to time. The effective date above always reflects the current version. Material changes are announced on the Service, and for Subscriptions they take effect no earlier than your next renewal. Your continued use of the Service after a change takes effect constitutes acceptance; if you do not accept the changed Terms, stop using the Service and cancel any active Subscription.

• If any provision of these Terms is held unenforceable, it is modified to the minimum extent necessary, and the remainder stays in force.
• These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
• We may assign these Terms in connection with a sale or reorganization of the business; you may not assign them without our written consent.
• Our failure to enforce a provision is not a waiver of it. We are not liable for delay or failure caused by events beyond our reasonable control.
